EYE LICENSE AGREEMENT<\/p>
The following license governs the use of Eye in\nacademic and educational environments. Commercial use requires a commercial\nlicense from Synteda.<\/p>
This license contains the terms and conditions of\nusing Eye in non-commercial settings grating you the right to use the software\nfor educational, research or evaluation purposes only, but prohibits any\ncommercial use.<\/p>
This license retains the possibility for Eye authors\nto sell commercial licenses. In fact, if you intend to use Eye in a \u201cfor-profit\u201d\nenvironment, where research is conducted to develop or enhance a product, is\nused in a commercial service offering, or when a commercial company uses Eye to\nparticipate in a research project (for example government-funded or EU-funded\nresearch projects), then you need to obtain a commercial license for Eye. In\nthat case, please contact the Author to inquire about commercial licenses.<\/p>
The license entitles you to use the Software to\nconduct research or education and non-commercial research endeavors.<\/p>
The license is limited to noncommercial use.\nNoncommercial use relates only to educational, research, personal or evaluation\npurposes. Any other use us commercial use. For using the software for\ncommercial purposes, you have to contact the Synteda for an appropriate\nlicense. Permission is also granted to use the software for a reasonably\nperiod of time for the purpose of evaluating its usefulness for a particular\npurpose.<\/p>
If you distribute the Software or any derivative works\nof the Software, you will distribute them under the same terms and conditions\nas in this License, and you will not grant other rights to the Software or\nderivative works that are different from those provided by this License.<\/p>
4.1 You agree that Synteda may collect and use\ntechnical information gathered from you in order to facilitate the\nfunctionality and identify support needs of the Software as well as improve the\nSoftware.<\/p>
4.2 Any personal data submitted to Synteda by you\nshall be processed and\/or transferred in strict accordance with the applicable\ndata protection laws. It is your responsibility to, if necessary, obtain\nconsent from the personal data holder to process and transfer any personal data\nto Synteda.<\/p>
You may not copy, modify, sublicense, or distribute\nthe Software except as expressly provided under this License. Any attempt\notherwise to copy, modify, sublicense or distribute the Program is void, and\nwill automatically terminate your rights under this License.<\/p>
6.1 Any and all intellectual property rights to the\nSoftware and all rights protecting it, including but not exclusively know-how,\ncopyright, distinctive mark and registered design, Synteda trademark(s), the\nSupport Materials and any Updates are owned and shall be vested in Synteda, and\nno ownership rights to the Software, Support Materials or Updates shall be\ntransferred.<\/p>
6.2 Unauthorized use or copy of the Software\nconstitutes unlawful infringement of intellectual property rights and may lead\nto liability for damages or other remedies in accordance with the legislation\nin force and\/or this Agreement. Any use of the Software requires permission\nfrom Synteda.<\/p>
6.3 Synteda, Eye and other trademarks contained in the\nSoftware are trademarks or registered trademarks of Synteda in Sweden and\/or\nother countries. You may not remove or alter any trademark, trade names,\nproduct names, logo, copyright or other proprietary notices, legends, symbols\nor labels in the Software. You have no right to remove or in any other way harm\ntrademark or copyright sign of the Software or undertake any changes in any of\nthe Software\u2019s rights.<\/p>
The provider makes no representations about the\nsuitability, use, or performance of this software or about any content or\ninformation made accessible by the software, for any purpose. the software is\nprovided \u201cas is,\u201d without express or implied warranties including, but not\nlimited to, any implied warranties of merchantability, fitness for a particular\npurpose, or noninfringement with respect to the software. the provider is not\nobligated to support or issue updates to the software.<\/p>
8.1 In no event shall Synteda be liable under any\ntheory for any indirect, incidental, special, consequential, punitive, or tort\ndamages, nor for any loss of use or data.<\/p>
8.2 In no event does Synteda authorize you to use the\nSoftware in applications or systems where the Software\u2019s failure to perform can\nreasonably be expected to result in a significant physical injury, loss of life\nor financial damage. Any such use by you is entirely at your own risk, and you\nagree to hold Synteda harmless from any claims or losses relating to such\nunauthorized use.<\/p>
8.3 You assume full responsibility for its use of the\nSoftware and use of any programs tested by the Software and any information\nentered, used and stored therein. You furthermore assume full responsibility\nfor ensuring that data is not inadvertently modified, deleted, destroyed or\ndisclosed, and for the accuracy and integrity of the results. Synteda assumes\nno responsibility for your negligence or failure to take adequate measures to protect\ndata from inadvertent modification, deletion, destruction or disclosure.<\/p>
8.4 The limitation liability set forth herein shall\nnot apply in case of willful misconduct or gross negligence.<\/p>
This Agreement contains the entire agreement between\nthe parties with respect to the subject matter hereof, and supersedes all prior\nor contemporaneous agreements or understandings, whether oral or written.<\/p>
<h4>10. Governing Law and Jurisdiction<\/h4><\/p>
This Agreement shall be governed by and construed in\naccordance with the laws of Sweden, without reference to its conflicts of law\nprovisions. Any dispute, controversy or claim arising out of, or in connection\nwith, this Agreement, or the breach, termination or invalidity thereof, shall\nbe exclusively settled by the competent courts of Sweden.<\/p>
